Brainiac Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Brainiac platform and services. This AUP is incorporated into and forms part of our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.


1. Prohibited Conduct

You may not use the Service to:

1.1 Provide False or Misleading Information

  1. Submit Business Context that you know to be inaccurate, incomplete, or misleading
  2. Generate Compliance Documents based on fabricated business information
  3. Create an account for a fictitious business entity
  4. Misrepresent your authority to act on behalf of a business

1.2 Unauthorized Use

  1. Use the Service on behalf of businesses you do not own, operate, or have written authorization to represent
  2. Create multiple accounts to circumvent usage limits or tier restrictions
  3. Share account credentials with unauthorized individuals
  4. Access another user's account or data without authorization

1.3 Technical Abuse

  1. Scrape, crawl, or use automated means to access the Service beyond normal use of the scanning feature
  2. Reverse-engineer, decompile, or disassemble any part of the Service
  3. Attempt to extract, replicate, or reconstruct our law database, tool classification database, or matching logic
  4. Circumvent any security measures, access controls, or usage limits
  5. Interfere with the Service's operation or impose an unreasonable load on our infrastructure
  6. Probe, scan, or test the vulnerability of the Service without our written permission

1.4 Competitive Misuse

  1. Access the Service for the purpose of building a competing product or service
  2. Republish, resell, or offer generated Compliance Documents as your own product or service to third parties without our prior written authorization
  3. Use the Service to benchmark against a competing product

1.5 Illegal Activity

  1. Use the Service for any purpose that violates applicable law
  2. Use the Service to facilitate fraud, deception, or misrepresentation to regulatory agencies
  3. Publish Hosted Disclosure Pages that you know to be materially inaccurate with intent to deceive consumers or regulators

2. Scanning Feature

2.1 Permitted Scanning

The scanning feature is designed to scan publicly accessible websites that you own or have authorization to scan. By submitting a URL for scanning, you represent that:

  1. You own or are authorized to operate the website being scanned
  2. The website is publicly accessible (not behind authentication)
  3. You will use Scan Results solely for your own compliance purposes

2.2 Scanning Limitations

You may not use the scanning feature to:

  1. Scan websites you do not own or are not authorized to scan
  2. Conduct surveillance or competitive intelligence on third parties
  3. Circumvent rate limits by any means

3. Hosted Disclosure Pages

3.1 Content Standards

Hosted Disclosure Pages must:

  1. Accurately reflect your current business practices and compliance posture
  2. Be updated when your business circumstances change materially
  3. Not contain content that is defamatory, obscene, or illegal

3.2 Prohibited Content

Hosted Disclosure Pages may not contain:

  1. Content unrelated to AI compliance disclosures
  2. Advertising, promotional material, or links to unrelated commercial content
  3. Malicious code, scripts, or redirects
  4. Content that infringes third-party intellectual property rights

4. Enforcement

4.1 Graduated Response

We enforce this AUP through a graduated process:

  1. Warning -- We will notify you of the violation and request corrective action
  2. Feature Restriction -- We may restrict access to specific features (e.g., scanning, document generation)
  3. Suspension -- We may temporarily suspend your account pending resolution
  4. Termination -- We may permanently terminate your account for severe or repeated violations

4.2 Immediate Action

We reserve the right to skip the graduated process and take immediate action (including suspension or termination) for violations that:

  1. Pose a risk to the Service or other users
  2. Involve illegal activity
  3. Involve intentional misrepresentation to regulatory agencies
  4. Involve attempts to extract our proprietary data or algorithms

4.3 Content Removal

We may remove or disable Hosted Disclosure Pages that violate this AUP without prior notice.

4.4 Refunds

No refund will be issued for accounts terminated due to AUP violations.


5. Reporting Violations

If you become aware of a violation of this AUP, please report it to [TO BE DETERMINED].


6. Changes to This Policy

We may update this AUP from time to time. Material changes will be communicated in accordance with our Terms of Service.
