Summary
Maine LD 1727 (P.L. 2025, ch. 294) requires businesses using AI chatbots in trade and commerce to clearly and conspicuously disclose to consumers that the consumer is not engaging with a human being. Violation is a Maine Unfair Trade Practices Act violation. AG enforcement under Title 5 § 209 (up to $10,000 per violation). Private right of action under Title 5 § 213.

This law requires businesses using AI chatbots in trade and commerce to disclose to consumers that the consumer is not engaging with a human being.
A person may not use an artificial intelligence chatbot or any other computer technology to engage in trade and commerce with a consumer in a manner that may mislead or deceive a reasonable consumer into believing that the consumer is engaging with a human being unless the consumer is notified in a clear and conspicuous manner that the consumer is not engaging with a human being
